These Terms of Service (“Terms”) govern your access to and use of the website located at mcgcapitalpartners.com and any related services (collectively, the “Site”) operated by MCG Capital Partners (“MCG,” “we,” “us,” or “our”). By accessing or using the Site, or by submitting information through it, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Nature of our services

MCG Capital Partners is a hard money brokerage and funding advisory firm and is not a direct lender. We review and structure real estate financing scenarios and facilitate introductions to third-party lending partners. We do not originate, underwrite, fund, or service loans, and nothing on the Site is an offer or commitment to lend. All financing is provided by independent third-party lending partners on their own terms, subject to their own underwriting, approval, and documentation.

2. No guarantee of funding

Submitting information through the Site does not create a lending commitment and does not guarantee approval, funding, terms, pricing, or timing. Any figures, ranges, or timelines referenced on the Site are illustrative only, are not an offer, and are not a promise of any specific rate, cost, or outcome. Actual terms are determined solely by the applicable third-party lending partner for each transaction.

3. Eligibility and permitted use

You must be at least 18 years old and able to form a binding contract to use the Site. Financing facilitated through MCG is for business and investment purposes only and is not available to owner-occupants. You agree to use the Site only for lawful purposes and not to misuse, disrupt, scrape, reverse engineer, or attempt to gain unauthorized access to the Site or its systems.

4. Your submissions

When you submit a deal, partner inquiry, or other information, you represent that the information is accurate and that you are authorized to provide it. You grant MCG the right to use the information you submit to evaluate your request, communicate with you, and share it with third-party lending partners and service providers as described in our Privacy Policy.

5. SMS terms and communications

Program and sender. MCG Capital Partners offers optional SMS/MMS communications. Non-marketing messages concern your inquiry, appointment confirmations and reminders, and scheduling updates. Marketing messages concern our contractor financing services, educational content, and consultation invitations. Messages may be sent using automated technology, and we send only the categories for which you have opted in.

Your choice. Non-marketing and marketing SMS consent are collected separately through optional, unchecked boxes. Providing your phone number, submitting a form, or accepting these Terms does not by itself enroll you in SMS messaging. Consent to either category is not a condition of submitting an inquiry, making a purchase, or receiving any service.

Frequency and charges. Message frequency varies based on your inquiry, appointments, and the categories you select. Message and data rates may apply. Contact your wireless carrier with questions about your text or data plan. Carriers are not liable for delayed or undelivered messages.

Opt out. Reply STOP at any time to opt out of all MCG SMS messages, including non-marketing and marketing messages. You may receive a one-time opt-out confirmation; after that, we will not send further text messages unless you complete a new affirmative opt-in. A new inquiry or appointment alone does not resubscribe you. You may unsubscribe from marketing emails using the link in any such email.

6. Intellectual property

The Site and its content — including text, graphics, logos, and the MCG name and marks — are owned by MCG or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our prior written permission, except for your own personal, non-commercial reference.

7. Third-party links and services

The Site may link to or integrate third-party websites, tools, and services (for example, scheduling, analytics, or a third-party lending partner’s site). We do not control and are not responsible for third-party content, products, or practices, and your use of them is governed by their own terms and policies.

8. Disclaimers

The Site and all information on it are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MCG does not warrant that the Site will be uninterrupted, error-free, or secure. Nothing on the Site is legal, tax, financial, or investment advice.

9. Limitation of liability

To the fullest extent permitted by law, MCG and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or relating to your use of the Site or these Terms. To the extent liability cannot be excluded, MCG’s total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless MCG and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your submissions, or your violation of these Terms.

11. Governing law and venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
